These Terms take effect immediately for new users and on 17 February 2025 for existing users.

THESE TERMS OF SERVICE (“TERMS”) FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU (“YOU” OR “YOUR”) AND PROPROMPTHUB B.V. (“PROPROMPTHUB,” “WE,” “US,” OR “OUR”).
BY ACCESSING, BROWSING, DOWNLOADING OR USING ANY PART OF WWW.PROPROMPTHUB.COM, ITS SUB-DOMAINS, APPLICATIONS, OR RELATED CONTENT, PRODUCTS, AND SERVICES (COLLECTIVELY, THE “SERVICE”), YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS—INCLUDING THE LIMITATIONS OF LIABILITY, WARRANTY DISCLAIMERS, ARBITRATION/COURT CLAUSES, AND CLASS-ACTION WAIVER SET OUT BELOW.
IF YOU DO NOT ACCEPT EVERY PROVISION OF THESE TERMS, YOU MUST NOT USE THE SERVICE.
1. Introduction
1.1 Who We Are. ProPromptHub B.V. is a private company registered in the Netherlands, Chamber of Commerce number 97869651. We sell downloadable AI-prompt packages, templates, frameworks, and related digital materials to customers worldwide.
1.2 Language. These Terms were drafted in English. If any translation conflicts with the English version, the English version prevails.
1.3 Contact. All enquiries, refund requests, copyright notices, and legal correspondence must be submitted via the contact-form on www.proprompthub.com. We aim to respond within two (2) Dutch business days.
1.4 Privacy. Our Privacy & Cookie Policy explains how we collect, store, process, and share personal data. By using the Service you consent to that Policy.
2. Changes to the Terms or the Service
2.1 Updates to Terms. We may update these Terms from time to time. We will post the revised Terms and change the “Last updated” date. Material changes take effect thirty (30) days after posting; minor or clarifying updates take effect immediately. Continued use constitutes acceptance.
2.2 Changes to Service. We may modify, suspend, or discontinue any part of the Service at any time without liability—e.g., to introduce features, ensure legal compliance, or respond to unforeseen circumstances.
3. Eligibility and Cookies
3.1 Age. The Service is not available to individuals under eighteen (18). By using the Service, you represent you are at least 18 and able to form a binding contract.
3.2 Authority. If you accept these Terms on behalf of a legal entity, you confirm you have authority to bind that entity.
3.3 Export Compliance. You agree to comply with all applicable export-control and sanctions laws.
3.4 Cookie Notice.
a. Essential Cookies – Required for core site functionality (security, payments, login). Cannot be disabled.
b. Analytics Cookies – Help us understand traffic and improve performance. Optional.
c. Third-Party Cookies – Set by Stripe, PayPal, or embedded services (e.g., video players). Subject to their policies.
You can disable non-essential cookies via your browser; doing so may reduce site functionality.
4. Licence to Use the Service
4.1 Limited Licence. Upon full payment, we grant you a non-exclusive, non-transferable, non-sublicensable licence to download and internally use purchased digital products for your organisation’s business purposes.
4.2 Restrictions. Except where expressly permitted, you must not:
a. Resell, redistribute, or publicly display our products;
b. Share login details outside your organisation;
c. Reverse-engineer or extract underlying methodologies;
d. Use products to build competing services.
5. Content and User Submissions
5.1 Our Content. We retain all rights to prompts, templates, frameworks, documentation, site design, trademarks, and branding.
5.2 User Content Licence. If you submit reviews, testimonials, feedback, code snippets, or other material (“User Content”), you grant us an irrevocable, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display such material for any purpose, including marketing, without attribution or compensation.
5.3 Content Standards. User Content must not: (i) infringe intellectual-property rights, (ii) violate privacy or publicity rights, (iii) contain defamatory, hateful, obscene, or unlawful material, (iv) include spam or commercial solicitations.
5.4 Moderation. We may monitor, edit, or remove User Content at our sole discretion.
6. Prohibited Uses and Linking Policy
6.1 Prohibited Uses. You agree not to:
a. Violate any law or third-party right;
b. Upload viruses, malware, or malicious code;
c. Harvest or mine data;
d. Misrepresent affiliation with ProPromptHub;
e. Use the Service to create competing AI-prompt products;
f. Facilitate fraudulent or deceptive activities.
6.2 Linking to Us. You may link to our homepage provided the link is: non-deceptive, does not imply endorsement, and fits within your site context. We may request removal at any time. Use of our logo requires prior written permission.
7. Pricing, Payments, and Taxes
7.1 Prices. All prices are in euros (EUR) and include VAT where legally required. We may change prices at any time; changes do not affect confirmed orders.
7.2 Payment Processors. Payments are handled by Stripe or PayPal and subject to their terms.
7.3 Additional Fees. Your bank may impose currency-conversion or international-transaction fees; we are not responsible for these charges.
7.4 Taxes. You are responsible for any local taxes, duties, or charges. We collect VAT where applicable.
8. 30-Day Money-Back Guarantee
Eligibility Window: Thirty (30) days from purchase.
How to Claim: Submit a request via the contact-form with a detailed explanation of why the package is unfit and evidence of good-faith implementation efforts.
Processing Timeline: Acknowledge within two business days → evaluate within seven business days → refund (if approved) within seven–fourteen business days; minimum one-week handling period applies.
Limitations: Guarantee excludes enterprise/bulk orders, prior refund recipients, and requests after thirty (30) days. Payment-processor fees are non-refundable.
9. Intellectual-Property Rights
9.1 Ownership. ProPromptHub retains full ownership of all intellectual-property rights in the Service.
9.2 User Waiver. To the maximum extent permitted by law, you waive any present or future claim to copyright or other IP rights in our products—even if modified for internal use.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
PROPROMPTHUB DISCLAIMS ALL WARRANTIES—EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.
NO ORAL OR WRITTEN INFORMATION OR ADVICE CREATES ANY WARRANTY.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROPROMPTHUB’S TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES—including LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR GOODWILL.
Any claim must be filed within one (1) month of the cause of action.
12. Indemnification
You will indemnify and hold ProPromptHub, its directors, employees, and affiliates harmless from any claim, damage, or expense (including legal fees) arising out of: (i) your use of the Service, (ii) your breach of these Terms, or (iii) your infringement of any third-party right.
13. Suspension and Termination
13.1 We may suspend or terminate your account immediately for violations of these Terms, suspected fraud, non-payment, or to comply with law.
13.2 Upon termination licences cease and no refunds are granted except under Section 10.
14. Dispute Resolution; Class-Action Waiver
14.1 Governing Law. These Terms are governed by Dutch law.
14.2 Jurisdiction. You irrevocably submit to the exclusive jurisdiction of the competent courts of the Netherlands.
14.3 Class-Action Waiver. You waive any right to participate in class actions or representative proceedings. Disputes must be brought individually.
15. Force Majeure
We are not liable for failure or delay due to events beyond our reasonable control—e.g., natural disasters, pandemics, cyber-attacks, government restrictions, or third-party service failures.
16. Electronic Communications
You consent to receive all communications electronically via the email associated with your account or via notices posted on our website. Electronic communications satisfy legal written-notice requirements.
17. Miscellaneous
17.1 Entire Agreement. These Terms constitute the entire agreement between you and ProPromptHub and supersede all prior understandings.
17.2 Severability. If any provision is unenforceable, the remaining provisions remain in effect.
17.3 No Waiver. Failure to enforce any right is not a waiver.
17.4 Assignment. You may not assign your rights or obligations; we may assign ours without restriction.
